1. Acceptance of terms

By accessing or using the MyFairBill website at myfairbill.io and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of those changes.

2. Description of the Service

MyFairBill provides an online comparison and switching assistance service for Australian households. The Service allows you to:

  • Upload a utility bill (currently internet/NBN) to receive a personalised comparison of available plans;
  • View alternative plans from Australian providers with transparent pricing information;
  • Generate a negotiation email template to use with your current provider;
  • Follow links to provider sign-up pages to switch plans.

The Service is intended as an information and comparison tool only. MyFairBill does not act as an agent or representative of any provider, nor does it guarantee that any particular plan will be available to you.

3. Eligibility

You must be at least 18 years of age and a resident of Australia to use the Service. By using the Service, you represent and warrant that you meet these requirements.

4. Accuracy of information

We endeavour to ensure that all plan information displayed on the Service is accurate and up to date. However, plan prices, features, availability, and terms are set by individual providers and may change without notice. You should always verify current pricing and terms directly with the relevant provider before making any decision to switch.

MyFairBill does not guarantee the accuracy, completeness, or timeliness of any plan information displayed and accepts no liability for errors or omissions.

5. Referral arrangements

MyFairBill may receive a referral fee or commission from providers when you click through to a provider's website or sign up for a plan through a link on the Service. The existence of any such commercial arrangement does not affect our obligation to provide you with accurate and unbiased comparison results. We always aim to display the best available options for your circumstances.

6. Intellectual property

All content on the Service, including but not limited to text, graphics, logos, and software, is the property of MyFairBill or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Service without our express written permission.

7. User conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Upload any content that is false, misleading, harmful, or infringes any third-party rights;
  • Attempt to gain unauthorised access to any part of the Service or its related systems;
  • Use automated means (bots, scrapers, etc.) to access or collect data from the Service without our prior written consent;
  • Interfere with or disrupt the integrity or performance of the Service.

The Service contains links to third-party websites, including provider sign-up pages. These links are provided for your convenience only. We have no control over the content or practices of those sites and accept no responsibility or liability for them. Your use of third-party sites is at your own risk and subject to their own terms and conditions.

9. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of liability

To the maximum extent permitted by law, MyFairBill and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including but not limited to loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to the Service will not exceed AUD $100.

11. Indemnification

You agree to indemnify and hold harmless MyFairBill and its directors, employees, and agents from any claims, losses, liabilities, damages, and expenses (including legal fees) arising out of or in connection with your use of the Service or your breach of these Terms.

12. Governing law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or relating to these Terms or the Service.
